Transition from 2006/42/EC to the (EU) 2023/1230 Machinery Regulation

The Machinery Regulation applies from 20 January 2027. The key changes manufacturers need to know.

Timeline

The (EU) 2023/1230 Machinery Regulation applies from 20 January 2027, on which date 2006/42/EC is repealed. The Regulation applies directly in the EU; in Türkiye, the national legislation to be published within the framework of the Customs Union is being monitored.

Annex numbers have changed

In the Regulation, the conformity assessment procedures are set out in new annexes: EU-type examination in Annex VII, conformity to type in Annex VIII, full quality assurance in Annex IX and unit verification in Annex X. The essential health and safety requirements are in Annex III. The old annex numbers should no longer be used.

Part A and Part B

Machinery subject to third-party conformity assessment is listed in Annex I in two parts. For products in Part A, a notified body is mandatory. For products in Part B, internal production control (self-declaration) is possible if harmonised standards have been applied in full; otherwise a notified body is required.

Digital risks

The Regulation explicitly covers digital risks such as the reliability of control systems, software and systems with self-evolving behaviour. The risk assessment is expected to address these topics. Instructions for use may also be provided in digital format.

What should you do?

  • Determine whether your product is listed in Annex I Part A or Part B.
  • Review your technical documentation against Annex IV.
  • Add software and control system topics to your risk assessment.
  • Plan for the validity and renewal of your existing 2006/42/EC certificates.
